A bench trial is a trial by judge as opposed to a trial by jury. The term is chiefly used in common law jurisdictions which use both trials by a judge and by a jury, so as to distinguish as to the type of trial.

CONS

  • Only one finder of facts (judge

  • Not as emotionally "swayable" as a jury would be.

PROS

  • Experienced judge decide the case, rather than laypersons.

  • It can save a great deal of time and money.

  • Judges, unlike jurors, have to follow a Code of Judicial Ethics.

  • A Jury might not know that a witnesses testimony most likely isn't one hundred percent true whereas experienced people in the courtroom do.
